This role will lead the implementation and support of the MPT, Pharmaceuticals (Pharma), Functions (WWM and QA) on Data Privacy compliance, as well as support the day-to-day management of the privacy program in LATAM geographies in accordance with Baxter's Global Privacy Policy, GDPR policy, as well as HIPAA, CCPA/CPRA and other state laws, GDPR, and local privacy laws in the applicable geographies. The role will have to partner as appropriate with senior functional leaders in order to: (i) mobilize resources across the organization to implement the Data Privacy program, so that Baxter employees can achieve their business goals consistent with Baxter's values and standards and applicable data protection legal requirements, and (ii) enable the development and execution of innovative data-driven business initiatives while ensuring compliance with data privacy and data protection laws in US and LATAM geographies.

The Position will report to the Associate General Counsel, Head of Privacy HST & CPS- US.Role and responsibilities
Act as the main advisor and SME for the MPT and Pharma segments and support the initiatives, projects and product assessments providing practical, timely, strategic, and high-quality legal advice on data privacy and roll out under Global Privacy Laws.
Provide pragmatic legal advice on data-driven projects including mobile applications, artificial intelligence, data analytics, software as a medical device.
Strategically assess potential privacy risks with innovative new initiatives and develop appropriate controls, training, and mentorship to ensure compliance with applicable privacy laws and Baxter's Privacy Program.
Monitor developments in global data privacy laws (and related legislation and industry practices).
Support operationalization of compliance with regional and local laws such as HIPAA, CCPA/CPRA, state laws, GDPR, and/or local laws in the geographies, including LATAM.
Drive Baxter's Privacy compliance efforts and achievements, while building a culture of privacy.
Attend or facilitate the Privacy Office meetings and serve as a first point of contact for the country Local Privacy Champions (LPCs).
Be able to act independently and provide legal advice and counsel to Baxter on privacy matters.
Partner and interact closely with business and/or functional leaders and/or teams in the identification of privacy related issues and support in the efficient resolution.
Identify areas of vulnerability and risk and undertake corrective plans to resolve the issues.
Build awareness and perform trainings, as needed, following the Baxter Privacy Office Curriculum and functional needs.
Conduct or support internal investigations of allegations of potential data breaches.
Lead data subject requests as per privacy laws.
Conduct privacy impact assessments as the need arises in the geographies under the supervision of Baxter Privacy Office.
Draft and negotiate Business Associate Agreements and/or Data Processing Agreements, as applicable, with Baxter's vendors and customers.
Perform due diligence exercises on Baxter's potential partners from a data protection compliance standpoint.
Maintain up to date privacy expertise, skills, and proficiency regarding evolving laws, regulations, mentorship, and directives impacting Baxter internationally.Position requirements
Law Degree from a US jurisdiction and active bar membership.
7+ years of professional experience in an international company or in an international law firm in the area of data protection. The ideal candidate will have experience gained from a mix of law firm private practice and in-house positions in companies engaged in the life-sciences sector.
